Kanna Productions is an artist and shop vendor. Commissions will always be completed within the estimated time frames, unless circumstances arrive. In that case, Commissioners will be kept up to date until projects are complete.
Commissions are generally not worked on every single day. Commissioners may ask for updates prior to receiving one from the artist, but please remember that this is a single creator with a life and a job. Try to be patient. It saves everyone a lot of stress and anxiety.
All Commissioners regardless of cost of project must read and agree to terms of service.
Commissioner retains Artist to create unique artwork with the final work to be delivered digitally via the Commissioner’s Email. This JPG file will be minimum 1600x2000 pixels, with artist signature & logo. DPI will be no higher than 100. This file will be formatted for best viewing on a digital screen rather than printing. This purchase is not to be resold or used for commercial purposes.
For an additional ONE TIME fee, the Commissioner may purchase Grant of Commercial Rights (this fee is required for EACH piece of artwork commissioned). This gives the Commissioner rights to print, use, and sell the artwork for commercial purposes. The Commissioner will also gain exclusive access to a 300-600 dpi (Commissioner’s choice) print ready file without logo or signature.
Grant of Rights is ONLY available for original content—not fanart or other copyrighted content).
1. Price and Payments.
Commission Fee Costs are available in my shop. Commissions maybe purchased through my shop or through invoice by contacting us through email or the contact form.
(paypal, debit/credit, and other payment methods are available).
If desired, Commissioned artwork maybe ordered as a physical print from a Professional Printing Company. Offers include:
8 x 10 ($20 each - or for free if ordered with Commission + print offer) or 11 x 17 ($25 each). Other Print and Canvas offers are available in shop.
Cost for Print Shipping and Handling will be estimated at checkout.
Prints are shipped flat.
Sales tax maybe charged if located within Louisiana.
Cost for Grant of Rights, including but not limited to printing, selling, and commercial use rights, and a 300-600 dpi, print ready file, (watermark & signature free):
The cost of Grant of Rights = 100% Price of Purchased Commission
Without Grant of Rights, Commissioner may ONLY use the commissioned artwork and any purchased prints for personal use.
PAYMENT METHODS
If not paid entirely up front or through my shop, Artist requires 50% of total down as a nonrefundable retainer. Commissioner will receive periodic updates with opportunities to approve work or make suggestions. On final approval, payment for the final percentage will be billed. Transfer of any digital files, and any printing and Grant of Commercial Rights transferals if purchased will occur when Artist receives payment in full.
Digital files and Grant of Rights (if purchased) will be transferred to the Commissioner via email. Once the print shipment arrives, any physical artwork will be shipped out to the Commissioner as well, and the transaction will be marked complete.
Payments may be made in shop, invoice, or in person (we have an option for cash/check/and POS upon checkout when ordering through shop). Any Invoices will be sent via email or the customer's phone number (with their consent). Payment will be due within 10 days of the invoice being sent. Again, work will not start until retainer payment or full payment is paid.
· Alternative Monthly Payment Plan:
In place of the normal 50% down for retainer/50% due at completion payment schedule, the Artist offers a monthly payment schedule on approval. This payment schedule will last 2- 6 months (no later).
Total Price of order will be divided equally between the months within the agreed upon timeframe. The Commissioner may pay off the total at any time before completion of this payoff schedule.
Work timeline for payment plans:
No deadline specified. Work will progress from time down payment is received until finished.
3. Grant of Rights. If purchased, Artist agrees to the perpetual exclusive license of all rights (including, but not limited to, the right to display, modify, transmit, transfer, sell, and create derivative works. Derivative works include, but are not limited to apparel, toys, keychains, accessories, digital media, etc... )
This excludes only these specific rights reserved to the artist: authorship credit, right of artist to produce and sell a limited edition of 100 or less art prints (exception being if Commissioner owns Copyright of the Artwork’s subject(s)), and the right to show and sell the original artwork if not purchased by commissioner (same exception as noted prior).
This Grant of Right is a flat fee. The Artist cannot seek anymore compensation for Grant of Rights nor can Artist attempt to resell or publish any rights to the Work, except as noted in 4. below.
4. Artist's Reserved Rights. Commissioner and Artist agree that when asked, Commissioner
must properly credit or identify Artist as the creator of Work. Artist may use Work in Artist's portfolio (including, but not limited to, any website that displays Artist's works).
Artist reserves the right to produce, sell, and promote a limited edition of 100 or less fine art prints.
Artist reserves the right to promote and sell the original Art if not purchased by Commissioner (Same exception as noted in 3.)
5. Artist's Creative Vision. Commissioner agrees that Artist will complete Work in Artist's creative style at Artist's discretion. However, if Commissioner demands Work be redone or changes to be made, it is understood that the Artist must comply with said changes.
2 opportunities for major changes are free of charge. After those 2 opportunities are used, compliance of the Artist will be compensated per additional revision made (price depends on complexity of revisions). Payment is due up to 7 business days after revision request. If payment is not received within this time parameter, work on commission will halt until payment is obtained.
Artist will not resume until payment is made, unless client sends in a written statement or message through email/text stating that they want to cancel the revisions and to continue the project.
.
6. Cancellation, and Expiration. If Commissioner does not want or refuses to receive Work, Artist may decide whether or not to complete Work, and will exclusively retain all right to Work that has already been made (except in the case of copyrighted material owned by Commissioner).
In most cases, in the event that this circumstance occurs the Artist is entitled to keep the payments that have been made thus far.
In the case that payment is made in full up front, the Commissioner will be refunded upon cancellation, minus a cancellation fee that covers the work already completed.
Example: 75% of art completed = 25% of cost refunded.
7. Limitation of Liability. Commissioner agrees that Artist will not be liable for any damages (including, but not limited to, incidental or consequential damages), that arise from Artist's performance of this commission (including, but not limited to, failure to perform in a timely manner, regardless of whether the failure was intentional or negligent.)
8. Dispute Settled by Arbitration, and Governing Law. Any dispute under or about this Agreement must be submitted to and resolved by arbitration. Parties will bear their own costs. Any court may enforce the arbitration award. This Agreement will be governed by the laws of Louisiana, in the country of The United States of America.
